1. Introduction  

Welcome to Your Choice Mart ("Platform"), owned and operated by Your Choice Import and Export ("Company", "we", "our", or "us"). These Terms & Conditions ("Terms") govern your access to and use of our website, mobile applications, and related services, including ordering products, deliveries, retailer purchases, wallet services, promotions, customer support, and all other services offered through the Platform.

Our Platform serves two categories of users:

Customers (Consumers): Individuals purchasing products for their personal or household use.

Retailers (Business Buyers): Verified businesses, shops, or commercial entities purchasing products for resale or business operations.

By accessing, registering, browsing, or using any part of the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms, our Privacy Policy, Return & Replacement Policy, and any additional policies published by the Company from time to time.

These Terms are designed to ensure a secure, transparent, and reliable shopping experience for all users while protecting the interests of both our customers and retailers. If you do not agree with any part of these Terms, you should discontinue using the Platform immediately.

The Company reserves the right to update or modify these Terms at any time. Continued use of the Platform following any updates constitutes your acceptance of the revised Terms.

2. Definitions  

For the purpose of these Terms, the following definitions shall apply unless the context requires otherwise:

Company means Your Choice Import and Export, the owner and operator of the Platform.

Platform refers to the Your Choice Mart website, Android application, iOS application, and any related online services.

Customer means an individual who purchases products primarily for personal, family, or household consumption.

Retailer means a verified business user, shop owner, distributor, reseller, or commercial entity approved by the Company to purchase products for business or resale purposes.

User refers collectively to Customers, Retailers, visitors, and any individual accessing the Platform.

Order means a request submitted by a User to purchase one or more products through the Platform.

Wallet refers to the digital wallet provided by the Platform for eligible refunds, promotional credits, cashback, or other approved transactions.

Replacement means the exchange of an eligible product for another product in accordance with the Company's Return & Replacement Policy.

Delivery Partner refers to the Company's authorized delivery personnel responsible for delivering and collecting products.

Unless otherwise stated, words in the singular include the plural and vice versa.

3. Acceptance of Terms  

By creating an account, placing an order, browsing the Platform, or using any service offered by Your Choice Mart, you confirm that you have read, understood, and agreed to comply with these Terms & Conditions.

These Terms form a legally binding agreement between you and the Company. Your continued use of the Platform signifies your acceptance of any future amendments or updates published by the Company.

If you are using the Platform on behalf of a business or organization, including as a Retailer, you represent that you have the authority to bind that business to these Terms.

The Company reserves the right to refuse access to the Platform, suspend services, or terminate accounts if any User violates these Terms, engages in fraudulent activities, misuses the Platform, or acts in a manner that may adversely affect the Company, its users, or its business operations.

Users who do not agree with these Terms must discontinue use of the Platform immediately.

4. Eligibility & Account Registration  

To use the Platform, you must possess the legal capacity to enter into a binding agreement under the applicable laws of India.

Customers must provide accurate and complete information during registration, including their name, mobile number, email address (where applicable), and delivery address. Verification may be completed using One-Time Password (OTP) authentication or other verification methods determined by the Company.

Retailers are required to provide additional business-related information, such as business name, shop details, GST registration (if applicable), trade license, or any other documentation requested by the Company. Retailer accounts may remain pending until verification and approval are completed.

Each User may maintain only one primary account unless otherwise approved by the Company. Users are responsible for ensuring that the information provided remains accurate and up to date. Providing false, misleading, or incomplete information may result in rejection, suspension, or permanent termination of the account.

The Company reserves the right to approve, reject, suspend, or deactivate any account at its sole discretion where required for security, legal compliance, or operational reasons.

5. Customer & Retailer Accounts  

Upon successful registration and verification, Users will receive access to their respective accounts based on their assigned role. Customer accounts are intended solely for personal purchases, while Retailer accounts provide access to business-specific features, pricing, promotions, and services approved by the Company.

Customers are responsible for maintaining the confidentiality of their login credentials and ensuring that all activities conducted through their account are authorized. Retailers are similarly responsible for managing access within their organization and ensuring that only authorized personnel use their business account.

Users must immediately notify the Company if they suspect unauthorized access, security breaches, or misuse of their account. The Company may temporarily suspend access while investigating such incidents to protect both the User and the Platform.

The Company reserves the right to modify account privileges, request additional verification, restrict certain features, or suspend accounts where necessary to comply with legal requirements, prevent fraud, or maintain the security and integrity of the Platform.


6. Account Security  

Your Choice Mart is committed to maintaining a secure and reliable shopping environment for both Customers and Retailers. Users are responsible for safeguarding the confidentiality of their login credentials, including passwords, One-Time Passwords (OTPs), verification codes, and any other authentication information associated with their accounts. These credentials must not be shared with any other person or organization.

You are solely responsible for all activities conducted through your account until you notify the Company of any unauthorized access or security concern. If you suspect that your account has been compromised, your password has been disclosed, or unauthorized transactions have occurred, you must immediately contact our Customer Support team. The Company may temporarily suspend your account while investigating the matter to prevent further unauthorized activity.

For security purposes, the Company may implement multi-factor authentication, OTP verification, CAPTCHA, device verification, session expiration, or other security measures at any time. Users agree to cooperate with such verification processes whenever required.

The Company reserves the right to suspend, restrict, or permanently terminate any account that is suspected of being involved in fraudulent activities, unauthorized access, identity theft, automated attacks, or any activity that may compromise the security or integrity of the Platform.

7. Products & Catalogue  

Your Choice Mart offers a wide range of grocery, household, personal care, beverages, fresh produce, and other consumer products through its digital platform. Product availability may vary depending on inventory, delivery location, operational limitations, seasonal availability, or supplier constraints.

The Company makes reasonable efforts to ensure that product names, descriptions, specifications, pricing, nutritional information, images, and other details displayed on the Platform are accurate and up to date. However, actual products, packaging, branding, colours, weights, sizes, promotional labels, or manufacturer information may differ slightly from the images or descriptions shown due to supplier updates or manufacturing changes.

Product images displayed on the Platform are intended for illustrative purposes only and should not be considered an exact representation of the delivered product.

The Company reserves the right to modify, discontinue, replace, or limit the availability of any product at any time without prior notice. If an ordered product becomes unavailable after an order is placed, the Company may offer an alternative product, partially fulfil the order, or cancel the unavailable item with an applicable refund in accordance with the Company's Refund Policy.

Retailer-exclusive products, promotional bundles, wholesale packs, and business pricing may only be visible to approved Retailer accounts.

8. Pricing & Taxes  

All prices displayed on the Platform are quoted in the applicable local currency and include or exclude applicable taxes as required under prevailing laws. Product prices may vary based on user type (Customer or Retailer), location, promotional campaigns, product variants, delivery zones, market conditions, supplier pricing, or other commercial factors.

Additional charges such as delivery fees, handling charges, packaging charges, service fees, convenience fees, or government taxes may apply depending on the selected products, order value, delivery method, and applicable regulations. All applicable charges will be displayed to the User before order confirmation.

The Company makes every effort to maintain accurate pricing information. However, typographical errors, technical issues, synchronization delays, or supplier updates may occasionally result in incorrect pricing or promotional information. In such cases, the Company reserves the right to cancel, modify, or refuse any order containing pricing inaccuracies, even after payment confirmation, and will notify the User accordingly.

Prices displayed for Retailers may differ from those displayed for Customers based on approved business pricing structures, wholesale pricing, negotiated agreements, or promotional programs.

9. Retailer Pricing & Bulk Purchase Policy  

Approved Retailers are provided with business-specific purchasing benefits designed to support commercial operations and resale activities. Retailer pricing is determined based on the Company's wholesale pricing policies, promotional programs, purchase quantities, product availability, and other commercial considerations.

Certain products may have Minimum Order Quantity (MOQ) requirements, carton-based sales, bulk packaging, or retailer-exclusive pricing. These conditions will be displayed on eligible products where applicable. Retailers are responsible for reviewing all pricing, quantity requirements, and applicable terms before placing an order.

Retailer pricing, discounts, promotional offers, and business incentives are confidential and intended solely for the approved Retailer account. Such pricing must not be misrepresented, shared publicly, or misused in any manner that could adversely affect the Company's commercial operations.

The Company reserves the right to modify retailer pricing structures, promotional benefits, eligibility requirements, purchase limits, or business policies without prior notice based on market conditions, supplier agreements, inventory availability, or operational requirements.

Any misuse of retailer privileges, fraudulent purchasing activities, unauthorized resale practices, or violations of these Terms may result in suspension or permanent termination of the Retailer account and cancellation of associated business benefits.

10. Orders & Order Acceptance  

Users may place orders through the Platform by selecting available products and completing the checkout process. Submission of an order constitutes a request to purchase products and does not automatically guarantee acceptance by the Company.

Upon successful submission, Users may receive an order acknowledgement through the Platform, email, SMS, or push notification. This acknowledgement confirms receipt of the order request but does not constitute final acceptance. Orders are subject to verification of product availability, pricing, payment status, delivery location, fraud prevention checks, operational capacity, and other internal validation processes.

The Company reserves the right to accept, reject, partially fulfil, modify, or cancel any order at its sole discretion for reasons including, but not limited to, product unavailability, pricing errors, suspected fraudulent activity, delivery limitations, duplicate orders, regulatory requirements, or force majeure events.

Once an order has been accepted, the Company will begin processing it for packing, dispatch, delivery, or pickup. After processing has commenced, cancellation or


11. Payment Methods  

Your Choice Mart offers secure and convenient payment options for both Customers and approved Retailers. Depending on the services available in your location, payments may be made through Cash on Delivery (COD), Digital Wallet, UPI or any other payment methods introduced by the Company from time to time.

Customers are responsible for ensuring that the selected payment method is valid and that sufficient funds are available to complete the transaction. For Cash on Delivery orders, payment must be made in full at the time of delivery unless otherwise approved by the Company. Delivery Partners may verify payment before handing over the order.

Retailers purchasing under business pricing or approved credit arrangements shall comply with the agreed payment terms. The Company reserves the right to suspend further orders, modify payment privileges, or recover outstanding dues where payments remain overdue.

All payment transactions are subject to verification and fraud prevention measures. The Company reserves the right to cancel or hold any transaction that appears suspicious, unauthorized, or inconsistent with normal purchasing behaviour. Payment confirmations may be delayed due to banking systems, payment gateway processing, or technical issues beyond the Company's control.

12. Wallet Policy  

The Platform may provide a digital Wallet feature for eligible Customers and Retailers. The Wallet is intended to facilitate wallet refunds, promotional credits, cashback rewards, loyalty benefits, or other credits approved by the Company. Wallet balances do not constitute a bank account and do not earn interest.

Refunds approved under the Company's Return & Replacement Policy may be credited to the Wallet where applicable. Wallet balances may be used to pay for eligible purchases on the Platform, either fully or partially, subject to the Company's operational policies.

Wallet credits issued as promotional offers, cashback, referral rewards, or goodwill gestures may carry validity periods, usage restrictions, minimum purchase requirements, or other conditions, which will be communicated at the time of issuance.

Wallet balances are non-transferable, cannot be exchanged for cash unless required by applicable law, and may not be sold, assigned, or transferred to another user account.

The Company reserves the right to suspend, reverse, or cancel Wallet credits obtained through fraudulent activity, system abuse, duplicate accounts, policy violations, or technical errors. The Company may also modify the Wallet program or discontinue the Wallet service at its discretion by providing reasonable notice where practicable.

13. Delivery & Pickup Policy  

The Company strives to deliver products safely, accurately, and within the estimated delivery time displayed during checkout. Delivery timelines are estimates only and may vary due to weather conditions, traffic, public holidays, order volume, supplier delays, operational constraints, government regulations, or other unforeseen circumstances.

Users are responsible for providing a complete and accurate delivery address, valid contact number, and any necessary delivery instructions. Failure to provide accurate information may result in delivery delays, failed deliveries, or additional delivery charges.

For home deliveries, the recipient or an authorized representative must be available to receive the order. The Company's Delivery Partner may request verification such as OTP confirmation, order number, or other identification before completing the delivery.

Where Store Pickup is available, Users shall collect their orders from the designated pickup location within the specified collection period. Orders not collected within the applicable timeframe may be cancelled or disposed of according to the Company's operational procedures.

Ownership and risk of loss for products generally transfer to the User upon successful delivery or pickup confirmation. Users are encouraged to inspect the delivered products immediately and report any visible shortages or damages without undue delay.

14. Return, Replacement & Wallet Refund Policy  

Customer satisfaction is important to the Company. However, due to the nature of grocery and retail products, return eligibility varies by product category and is determined by product-specific return conditions established by the Company.

Eligible products may be returned only within the return period specified for that product, which may range from a few hours after delivery to several days depending on the product category. Once the applicable return window has expired, requests for return or replacement may no longer be accepted.

Where a return request is approved, the available resolution will generally be either:

Replacement of the eligible product; or

Refund credited to the User's Wallet.

Cash refunds are generally not provided unless required by applicable law or specifically approved by the Company.

For approved returns requiring product collection, the Company may assign an authorized Delivery Partner to collect the product from the User's delivery location. Users must return the product in its original condition, along with any accessories, packaging, labels, invoices, or other materials requested by the Company.

The Company reserves the right to inspect returned products before approving any replacement or Wallet refund. Returns that do not satisfy the Company's eligibility criteria may be rejected.

15. Non-Returnable Products  

Certain products are not eligible for return, replacement, or refund due to hygiene, health, food safety regulations, perishability, or operational limitations. The list of non-returnable products may vary depending on product category, manufacturer policies, government regulations, or other applicable requirements.

Examples of products that may not be eligible for return include, but are not limited to:

Dairy products.

Frozen food items.

Opened food items.

Personal care or hygiene products once opened.

Baby care products where packaging has been opened.

Customized or specially ordered products.

Gift cards, promotional items, or complimentary products.

Products specifically marked as "Non-Returnable" on the Platform.

Return eligibility will always be determined based on the product-specific policy displayed on the Platform at the time of purchase.

Users are requested to carefully inspect their order at the time of delivery. Once products have been accepted without any immediate concerns, certain product categories may no longer qualify for replacement or refund. The Company's decision regarding product eligibility shall be final, subject to applicable consumer protection laws.
